Bachmann LS figures

I just received 10 B'mann LS figures that I purchased NIB. Among them is the seated engineer (http://www.bachmanntrains.com/home-usa/products.php?act=viewProd&productId=1008). Now that I have them all out of the packages and see them next to each other, they all look to be the right scale EXCEPT that engineer. He is noticeably smaller than the others. What scale is he in and why does B'mann sell him as LS along with the others?  ???

I think if he was any bigger he wont fit in the engine. Regards, Ron.

Even as small as he is I still have to cut parts of him off to fit in some loco's!!
