They are more or less the exact same item except the first one is at least 5 years old. I have bought things from the 2nd seller and never had any issues.

yeah the favorite spot is I believe the only authorized Bachmann dealer on eBay have bought from them several times and will continue too like the engine I will be getting next week

If you have any doubt about whether an eBay seller is a Bachmann authorized dealer, just ask him/her.  Nobody with a high rating on eBay is going to endanger their status by lying about it - they are well aware of what the consequences can be.  As for sellers with low ratings ...

Here is the other main dealer for Bachmann that is authorized, there are others (usually they will also have a brick and mortar establishment also), but these two list the most items.

I once asked someone on ebay if they were an authorized dealer, and as it turns out, they lied to me, and they had feedback of over 5,000 and like 99.9% positive. It is usually easy to tell, see what they are selling, if they are selling tons of Bachmann items that appear new then chances are he is an authorized dealer.

I hope you reported that seller to eBay along with copies of the appropriate emails.  eBay can and will sanction sellers for lying to buyers.  That is one of the reasons they encourage you to correspond with sellers only through the eBay messaging system.  Then they can retrieve their own copies of the emails.  You also have the option of posting negative feedback, but be sure you can back it up with all the 'he said ... she said.'  A third option available to you is to contact the owner of the seller's name.  Many sellers with very high feedback numbers use hirelings to do the actual selling under his/her user's name.  They have a valuable commodity to protect and would appreciate hearing about it if someone is telling lies using his/her name.

I told ebay, but they did nothing because they did not think it was that important and there wasn't much evidence, to support my case. Last time I checked the guy was still around, but not selling model railroad items.
